Payroll Service Owner Sentenced for Tax Fraud and Embezzlement

On March 16, 2015, in Los Angeles, California, Scott Willsea, an owner of Paycare, Inc., was sentenced to 37 months in prison and ordered to pay $1,873,617 in restitution. Willsea previously pleaded guilty to failure to pay federal payroll taxes intended for the IRS. According to the plea agreement, from at least 2008 through March 2011, Willsea, along with his wife, Isabel, co-owned and operated Paycare, a Riverside-based payroll service. During the 2009 and 2010 tax years, Willsea and Paycare prepared quarterly payroll taxes for at least 15 different client companies for which they failed to account for and pay over to the IRS the full amount of tax due and owed by each company. In at least 35 separate instances, Willsea collected from client companies of Paycare the entire amount they owed the IRS for payroll taxes and failed to pay the IRS the full amount. In each instance, Willsea kept a portion of the money for his own use and benefit.

Experts: Link Possible Between 2012 SC Hacking, Tax Fraud

COLUMBIA – Some cyber security experts believe much of the tax fraud hitting states, including South Carolina, is the result of the theft of personal information through hacking.

And two experts told The Greenville News that it is possible the massive hacking of South Carolina’s tax agency over two years ago may be playing some role in the spike in potentially fraudulent returns that caused the state last week to switch to paper checks for state tax refunds.

Former Illinois Home Builder Sentenced for Failing to Pay $1.27 Million in Federal Income Taxes

On Nov. 24, 2014, in Chicago, Illinois, Dennis Weiss, of South Elgin and formerly of St. Charles, was sentenced to 30 months in prison and ordered to pay $296,643 in restitution to the IRS. Weiss previously pleaded guilty to filing a false federal income tax return and making false statements in a bankruptcy petition. According to court documents, Weiss owned Custom Homes by D. R. Weiss, Inc., and Reliable Home Solutions, Inc. Weiss filed false individual federal income tax returns for 2005 through 2009, and he failed to file corporate tax returns for both of his companies. Between 2005 and 2009, Weiss paid personal expenses from Custom’s business bank account, accepted cash payments from Custom and Reliable customers, and failed to record the receipt of these funds on the books and records of the corporations, resulting in a total federal tax loss of $1,271,280. In Weiss’ personal bankruptcy petition, he intentionally concealed the existence of a company he owned and interests in three family held entities. In addition to criminal penalties, Weiss remains responsible for all taxes and interest due, as well as civil penalties of up to 75 percent of the tax owed.
